New law promotes arbitration to solve commercial disputes

New law promotes arbitration to solve commercial disputes

QĐND – Wednesday, July 21, 2010, 21:1 (GMT+7)

The Law on Commercial Arbitration Law recently passed by the National Assembly will provide an important legal foundation for businesses to minimise the risks of disputes, said the head of the Vietnam Chamber of Commerce and Industry’s legal department, Tran Huu Huynh.

Speaking at a conference in Hanoi on July 20 held to review the provisions of the new law, Huynh said few enterprises in Vietnam have yet paid much attention to arbitration, continuing to prefer to take their disputes to court rather than employ commercial arbitrators.

He added that the settlement of disputes by arbitration was fast, effective and confidential, and the arbitration of disputes would help ease the burden on the nation’s court system. Statistics from the Vietnam International Arbitration Centre have shown that the Hanoi People’s Court handled 300 economic disputes in 2009, while those in HCM City had a docket of around 1,000. Meanwhile, the centre last year handled only 58 petitions for arbitration from businesses.

“Every judge in Ha Noi and HCM City’s economic courts yearly handles from 30 to 50 disputes while the average arbitrator handles only one,” said Vietnam Law Association chairman Pham Quoc Anh.

The nation currently has a total of seven arbitration centres, but arbitration has not been popular in Vietnam due to a lack of a proper legal framework in the 2003 Ordinance on Commercial Arbitration.

“The law has improved shortcomings in the ordinance such as removing limitations on the application of arbitration to commercial disputes,” Anh said. “Commercial disputes, meanwhile, are increasing rapidly, requiring quick and efficient forms of settlement.”

The new law, which would take effect next January 1, would also create an equal legal footing for both Vietnamese and foreign enterprises, said the vice chairman of the National Assembly’s Justice Committee, Pham Quy Ty.

Retailers said public relations campaigns should be conducted to raise awareness among enterprises of the advantages of arbitration, said Dinh Thi My Loan, secretary general and standing vice chairwoman of the Association of Viet Nam Retailers.

Nam Dinh promotes advantages of developing human resources

QĐND – Monday, May 10, 2010, 22:19 (GMT+7)

Nam Dinh should promote the advantages of human resources to accelerate the application of advanced technologies in production and quickly develop industry, agriculture and high-quality services.

Prime Minister Nguyen Tan Dung made the statement during a working session with Nam Dinh provincial leaders on May 10.

He praised Nam Dinh province’s socio-economic achievements in recent years, such as the annual economic growth rate of 10 percent, industrial and services proportion of more than 70 percent and the number of poor households at 6 percent. This is a significant result but the province should not be selective, Mr Dung said, as its average per capita income and competitiveness are still low and there are no key products.

PM Dung asked provincial leaders to make a breakthrough in the next years. In the initial period, the province must fulfill set socio-economic development targets for 2010, step up industrial and agricultural production and services, and continue to develop handicraft industry. PM Dung said leaders should encourage all economic sectors to invest in industries of high added value, such as electronics, and accelerate disbursement of investment capital as well as better carry out social welfare policies and administrative reform. They should also make careful preparations for organisation of Party congresses at grassroots level.

Also on the same day, PM Dung made fact-finding tours of a project to build a new road linking Nam Dinh and Phu Ly, and a landslide on the Dao River. The province is asking the Government to provide around VND200 billion to build the 8km-embankment of the Dao River.

ATF 2009’s success promotes Vietnam’s image

QĐND – Monday, March 08, 2010, 21:12 (GMT+7)

The success of the 2009 ASEAN Tourism Forum (ATF) helped raise Vietnam’s tourism status in the region and offered opportunities for the country to promote its tourism potential abroad.

Nguyen Manh Cuong, Deputy Chief of the Vietnam National Administration of Tourism (VNAT), made the statement at a conference in Hanoi on March 8 to honour collectives and individuals for their outstanding achievements in the event.

He said ATF 2009 was a good forum for domestic travel companies to increase business capacity and seek opportunities for cooperation with foreign counterparts.

Vietnam hosted the largest regional tourist event for the first time from January 5-12, 2009. Despite the global economic and financial woes, the forum attracted a record high number of 2,064 delegates, comprising ministers, senior officials, businesses and media workers from ASEAN countries.

During the event, Vietnam had many bilateral meetings with foreign delegations to boost cooperation and garner support for its tourism development. The Ministry of Culture, Sports and Tourism (MoCST) launched a discount programme “Impressive Vietnam” at ATF 2009 to deal with falling numbers of foreign arrivals. The programme, which ended last December, brought fairly practical results.

Acknowledging the success of the forum, the Prime Minister has awarded the certificate of merit to two collectives and five individuals in MoCST; MoCST has presented the certificate of merit to 43 collectives and 71 individuals; and VNAT conferred awards on 23 collectives and 91 individuals.

In the past two months, Vietnam received more than 877,000 foreign visitors, an increase of 27.4 percent from a year earlier.
